Website Terms of Use
Last updated 1 September 2026.
These Terms of Use govern your access to and use of nivens.tech and its content. By using the website, you agree to these terms. If you do not agree, please do not use the website.
1. About these terms
The website is operated by DHD Group Pty Ltd ABN 92 608 566 150 under the registered business name Nivens Tech and the Nivens brand.
In these terms, the website means nivens.tech and any pages or content made available through it. Nivens, we, us and our refer to the operator of the website.
These terms apply only to use of the website. Any services supplied by Nivens are governed by the proposal, statement of work, service agreement or other terms agreed for those services. If there is an inconsistency, the terms agreed for the services apply to the extent of the inconsistency.
2. Website information
The website provides general information about Nivens and its technology, strategy, cloud, cyber security, growth and related services. Website content is provided for general information only and is not tailored advice.
You should obtain advice appropriate to your circumstances before acting on website content or making technology, cyber security, financial, legal or business decisions. A website enquiry, discovery call or other preliminary communication does not by itself create an adviser-client, supplier-client or other professional relationship.
3. Accuracy and availability
We take reasonable care in preparing and maintaining the website. However, content may be incomplete, out of date or contain errors, and the website may sometimes be unavailable. We may correct, update, suspend or remove website content when reasonably required.
We do not promise that the website will always be available, secure or free from errors or harmful code. You are responsible for using appropriate security measures, backups and safeguards when accessing the website.
4. Acceptable use
You must use the website lawfully and in a way that does not interfere with the website, our systems or another person’s use of the website.
You must not attempt to gain unauthorised access to the website or related systems; introduce malicious code; bypass security controls; scrape, copy or extract content by automated means in a way that materially burdens the website; impersonate another person; submit false, unlawful or harmful material; or use the website to infringe another person’s rights.
Reasonable indexing by public search engines and ordinary use of browser, accessibility and security tools are permitted.
5. Enquiries and submitted information
If you contact us or submit information through the website, you must ensure that the information is accurate and that you are authorised to provide it. Do not submit passwords, access keys, confidential credentials, sensitive personal information or other information that is not reasonably required for your enquiry.
Submitting an enquiry does not require Nivens to accept work, provide advice or enter into an agreement. We may respond, request further information or decline the enquiry.
6. Intellectual property
Unless stated otherwise, Nivens or its licensors own the intellectual property rights in the website and its original content, branding, design and materials.
You may view the website and make a reasonable copy or printout for your personal or internal business reference. You must not otherwise reproduce, modify, publish, distribute, sell, license, frame or commercially exploit website content without prior written permission, except where permitted by law.
Third-party names, logos and trade marks remain the property of their respective owners. Nothing on the website grants you a licence to use them.
7. Third-party websites and services
The website may link to, embed or rely on third-party websites, platforms or services. These are provided for convenience and may have their own terms and privacy practices. Unless expressly stated, a link or reference does not mean that we control, endorse or accept responsibility for the third party or its content.
8. Privacy
We handle personal information in accordance with our Privacy Policy and applicable privacy laws. Please read the Privacy Policy before providing personal information through the website.
9. Consumer rights
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
10. Liability
To the extent permitted by law, Nivens is not liable for indirect or consequential loss arising from your use of, or inability to use, the website or reliance on its general content. This does not apply to the extent that the loss was caused by our fraud, wilful misconduct or negligence, or where liability cannot lawfully be excluded or limited.
You remain responsible for decisions you make based on website content and for independently assessing whether information is suitable for your circumstances.
11. Restricting access
We may restrict or suspend access to all or part of the website where reasonably necessary to protect the website, users, our systems or our legal rights, or where we reasonably believe these terms have been materially breached. Where practical, we will limit the restriction to what is reasonably necessary.
12. Changes to these terms
We may update these terms to reflect changes to the website, our practices or the law. The updated terms will apply from the date stated at the top of the published version. If a change materially affects your use of the website, we will take reasonable steps to make the change clear on the website.
13. Governing law
These terms are governed by the laws of Queensland, Australia. The courts of Queensland and courts entitled to hear appeals from them have non-exclusive jurisdiction. This clause does not prevent you from relying on rights available under laws that apply to you and cannot be excluded.
14. General
If any part of these terms is invalid or unenforceable, it is to be read down to the extent necessary or, if that is not possible, severed. The remaining terms continue to apply.
A failure or delay in exercising a right under these terms does not waive that right.
